Applicable to all Employees

Planters

As the company has entered into tree planting contracts and wishes to employ Planters in completing these contracts and the Planter is willing to assist, it is agreed that:

  • The employee will provide all accommodations and personal clothing needed for working and sleeping in bush conditions.
  • The company will provide a mobile camp consisting of a clean cooking and dining shelter, showers and toilet facilities, and a drying shelter.
  • The company will provide showers, meals and a cook at a cost to the Planter as follows:
    • All Camps: Alberta Locations – $31.50 per day for planting days and $21.00 for non-planting days. Please note that 5% GST is included in this amount ($30.00+ $1.50 GST) and ($20.00+ $1.00 GST), respectively.  British Columbia Locations – $26.25 per day for planting days and non-planting days. Please note that 5% GST is included in this amount ($25.00 + $1.25 GST).  Where hotel rooms are provided instead of a camp a $15.75/day per person will be charged (including GST of $.75) for all days staying in hotel accommodation.
  • The employee will respect the rights of others in camp to have rest and quiet.
  • The company has a zero tolerance policy for any alcohol or drug abuse while working. Anyone found in a company vehicle or on the job in violation of this policy will be immediately dismissed.
  • There will be no smoking or chewing of tobacco in company vehicles.

Planting Quality and Penalties

As the quality of planting and the handling of stock is of the utmost importance in the survival and growth of the tree seedlings it is agreed that:

  • The company will make known to the employee all the quality guidelines established for each contract.
  • The company will supply a quality control inspector who will take and record daily quality plots on all planters so that in the event of planting quality problems and/or mishandling of stock, the appropriate employee(s) will be held accountable.
  • Failure to meet quality guidelines or to correct a quality problem will result in termination.
  • Failure to handle seedlings in the proper manner will result in termination.
  • Tree stashing will result in IMMEDIATE dismissal, and the employee will be paid the applicable hourly minimum wage plus holiday pay for any time owed instead of a piecework rate as it would be impossible to determine the number of trees planted.
  • Damages, vandalism and undue care causing damages or injury will result in suspension and/or termination and possibly legal proceedings in either Civil or Criminal court for recovery of costs.

Performance Expectation

As a provider of seasonal reforestation (tree planting) services, the company’s term of employment is also considered seasonal from project to project. The employee is therefore not guaranteed period specific employment and positions held within the company may exist from 1 to 115 days dependant on availability of work, performance requirements, and managing seasonal performance factors. Employees of the company understand that given the seasonal nature and expectations of performance within the requirements of the industry there are no guarantees for employment for the full plant season in any given year.

Pay Rates

  • Wages will be paid on a price per tree basis. These prices will vary between jobs based on terrain conditions and planting stock type. Planters will be advised of tree prices on a daily basis.
  • Vacation ay (4%) and statutory holiday pay (4%) will be paid on gross earnings as a combined holiday pay totaling 8%.

Deductions

The Employee agrees that the company will make the following deductions from gross pay:

  • Lawful deduction for Canada Pension Plan, Employment Insurance and Federal and Provincial Income Tax.
  • Any and all expenses incurred by the Company on behalf of the employee for items purchased at their request.
  • A $31.50/person day charge for Alberta and $26.25/person day for British Columbia locations including GST for showers, grocery and meal costs as previously outlined. Where hotel rooms are provided instead of a camp a $15.75/day per person will be charged (including GST of $.75) for all days staying in hotel accommodation.
  • Any loss or damage to company equipment will be charged back to the employee at the discretion of the project manager, through Civil Court Proceedings.

Record or Employment

Planters are assumed to work up to 12 hours per day; recorded hours worked per day will be calculated and totaled for ROE purposes. Planters choosing to leave their employment with the Company prior to the season end date (i.e., August 5th) will have ‘Quit’ identified on the ROE as the reason for leaving the job.

Cook

Cooks will be paid a per diem rate which includes holiday pay and stat holiday pay.

Cooks will be expected to feed the planters good wholesome food while operating cost effectively within the predetermined budget allowance as noted.

Cooks are expected to manage food costs so that the average cost does not exceed $21/day per person for each project over the course of the planting season.

Cooks will be expected to maintain daily records itemizing all purchases as to date and supplier, as well as a list of all persons they are feeding, and the number and types of meals served each day (excel spreadsheets are provided to assist with this tracking). Cumulative grocery costs (food and drink) will be divided by the cumulative total of planters fed to arrive at a daily cost of food per person fed. These daily records must be forwarded to NGR’s office in Beaverlodge on a weekly basis in the company’s Excel spreadsheet format provided. Failure to comply will result in no bonus at the end of the job and/or dismissal. All unused food items at the end of the season must be accounted for and returned to NGR management.

Cooks & assistants are assumed to work up to 14 hours per day. Total recorded hours worked per day will be calculated and totaled for ROE purposes. Cooks choosing to leave their employment with the Company prior to the season end date (i.e., August 5th) will have ‘Quit’ identified on the ROE as the reason for leaving the job.

Staff

Staff shall be paid a per diem rate which includes holiday pay and stat holiday pay.  Maintaining quality control and operational performance standards will form part of the annual review process.

Staff are assumed to work 14 hours per day. Total recorded hours worked per day will be calculated and totaled for ROE purposes. Cooks choosing to leave their employment with the Company prior to the season end date (i.e., August 5th) will have ‘Quit’ identified on the ROE as the reason for leaving the job.

Applicable to all Employees

All individuals wishing to be employed by the company are required to provide their accurate date of birth, social insurance number, and contact information prior to the commencement of work.   As the company has entered into tree planting contracts and wishes to employ Planters in completing these contracts and the Planter is willing to assist, it is agreed that:

Payroll Processing – Mandatory Direct Deposit

The Company processes payroll with the use of automatic bank deposits for payment of employee wages. All employees will need to provide accurate bank account information in order to receive payment for wages within the regular payroll periods. Please complete Schedule ‘A’ attached to this contract noting your personal account information for deposit purposes. Payroll stubs (statements) will be emailed directly to the employee at processing time. Employees are responsible to provide email addresses at the time of hiring for the purpose of receiving payroll information in a timely manner.

Probationary Period

All employees are required to comply with Company policies, procedures, rules, and quality performance expectations for the position you are hired to perform. As a new employee with the Company you will be on probation for a 90-day period during which time if, in the discretion of the Company, you are not meeting the terms, conditions, and requirements of your employment the Company may terminate your employment at any time without notice or payment in lieu of notice.

Other Information

The TD1 must be completed accurately. If it is incorrect, incomplete or unsigned, tax will be deducted at the highest rate, code 1. To change the code the TD1 must be corrected and signed again or a new one needs to be filled out. Deductions and taxes will be withheld in accordance with payroll legislation.
